Terms of Service

Welcome to BettaCool! These Terms of Service ("Terms") govern your use of the BettaCool mobile application ("App") operated by BettaCool ("we", "us", or "our"). By using the App, you agree to be bound by these Terms.

1. Eligibility

• You must be at least 13 years old to use BettaCool.
• If you are under 18, you must have parental or guardian consent.
• By creating an account, you represent that the information you provide is accurate and complete.

2. Your Account

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must not share your account with others or create multiple accounts.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to:

• Use the App in a lawful manner
• Respect other users and their content
• Post accurate information about your betta fish (lineage, genetics, sale listings)
• Complete transactions in good faith

You agree NOT to:

• Post offensive, harmful, threatening, or illegal content
• Harass, bully, or intimidate other users
• Post misleading information about fish (fake pedigrees, altered photos)
• Spam, advertise unauthorized products, or engage in scams
• Attempt to access other users' accounts or data
• Circumvent any security features of the App
• Use bots, scrapers, or automated tools to access the App
• Manipulate auctions (shill bidding, bid rigging)

4. User Content

4.1 Your Content

• You retain ownership of content you post (photos, videos, text).
• By posting content, you grant BettaCool a non-exclusive, worldwide, royalty-free license to display, distribute, and store your content within the App.
• You are solely responsible for the content you post.

4.2 Content Moderation

• We may remove content that violates these Terms or our community guidelines.
• We use a reporting and moderation system to handle violations.
• Repeated violations may result in account suspension or permanent ban.

4.3 Strike System

• Violations are tracked through a strike system.
• Accumulating strikes may result in temporary suspension or permanent account termination.
• Severe violations (illegal content, threats) may result in immediate termination.

5. User-Generated Content (UGC) Policy

5.1 Prohibited Content

BettaCool strictly does not allow the following types of content:

• Content that is obscene, vulgar, or sexually explicit
• Content that promotes or glorifies violence or cruelty (including animal cruelty)
• Content that constitutes harassment, bullying, or threats against any individual or group
• Content that is discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Content that is fraudulent, misleading, or deceptive
• Content that violates intellectual property rights of third parties
• Content that promotes illegal activities or substances
• Any content that violates applicable local or international laws

5.2 Reporting and Blocking

Users can report inappropriate content or block other users directly through features built into the App:

• Report Content: Tap the options menu (⋯) on any post, comment, or user profile and select "Report" to flag content that violates our guidelines.
• Block Users: Navigate to a user's profile and select "Block" to prevent them from interacting with you, viewing your content, or sending you messages.
• All reports are reviewed by our moderation team and handled in accordance with this policy.

5.3 Moderation and Enforcement

• Reported content is reviewed promptly against our community guidelines and these Terms.
• Content found to be in violation will be removed immediately.
• Users who post violating content will receive a warning or strike on their account.
• Users who repeatedly violate these Terms may have their accounts suspended or permanently terminated without prior notice.
• In cases of severe violations (threats of violence, illegal content, child exploitation), accounts will be terminated immediately and relevant authorities may be notified.

6. Marketplace & Transactions

6.1 Buying and Selling

• Sellers are responsible for the accuracy of their listings.
• Buyers and sellers are responsible for completing transactions and resolving disputes.

6.2 Auctions

• Bids placed in auctions are binding commitments.
• Winning bidders are expected to complete the purchase.
• Anti-sniping rules may extend auction end times.
• Manipulating auctions (shill bidding) is prohibited and will result in account termination.

7. Groups & Communities

• Group creators are responsible for managing their group content.
• Group administrators may set rules for their communities.
• Content posted in groups must comply with both group rules and these Terms.
• We reserve the right to remove groups that violate these Terms.

8. Intellectual Property

• The BettaCool name, logo, and App design are our intellectual property.
• You may not copy, modify, or distribute our App or its content without permission.
• Third-party trademarks belong to their respective owners.

9. Disclaimers

• The App is provided "as is" without warranties of any kind.
• We do not guarantee the accuracy of user-generated content.
• We do not verify the health, quality, or genetics of fish listed on the platform.
• We are not responsible for transactions between users.
• We do not guarantee uninterrupted or error-free operation of the App.

10. Limitation of Liability

To the maximum extent permitted by law, BettaCool shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Actions or content of other users
• Third-party service failures (payment processing, hosting)

11. Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Receive multiple content moderation strikes
• Are reported and confirmed for harassment or abuse

Upon termination, your right to use the App ceases immediately.

12. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated through the App. Your continued use of the App after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be resolved in the courts of Thailand.
